Terms of Service

1. Agreement to terms

By creating an account or using Looth ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding legal agreement between you and Looth ("we", "us", or "our").

2. Eligibility

You must be at least 13 years old to use Looth. By using the Service, you represent that you are at least 13 years of age. If you are between 13 and 18, you represent that you have your parent or guardian's permission to use the Service.

3. Your account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your password secure and not share it with others
  • Notify us immediately of any unauthorized use of your account
  • Not create accounts for others without their explicit permission

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Beta access and billing

Looth is currently in invite-only beta. During the beta period:

  • Beta access: Access to the Service during the beta period is provided free of charge to invited participants. No credit card is required to create an account during beta.
  • Future billing: Paid plans will be introduced after the beta period. Founding beta testers will have their plan price locked in at the beta rate for as long as they remain subscribed. We will provide at least 30 days' notice via email before any billing begins.
  • Price changes: We reserve the right to set and adjust subscription prices post-beta. We will provide at least 30 days' notice of any price change affecting your account.

5. Your content

You retain ownership of all content you upload to Looth, including photos, build and repair records, stage notes, and materials logs ("Your Content"). By uploading content, you grant us a limited, non-exclusive licence to store, display, process, and serve Your Content as necessary to provide the Service.

You represent that you have all rights necessary to upload Your Content and that it does not infringe any third-party intellectual property rights. We will not sell Your Content or use it for purposes unrelated to operating the Service.

6. Acceptable use

Looth is a platform for tracking instrument builds and repairs. You agree not to use the Service to upload, share, or transmit any content or data that:

  • Is sexually explicit, obscene, or adult in nature
  • Is illegal under applicable law, including CSAM (zero tolerance — reported immediately to NCMEC)
  • Infringes on any third party's intellectual property, trademark, or copyright
  • Constitutes spam, phishing, or deceptive content
  • Harasses, threatens, or demeans any individual or group
  • Contains malware, viruses, or harmful code
  • Attempts to gain unauthorized access to the Service or other users' accounts

Violations will result in immediate account termination. To report a violation, email hello@looth.build.

7. Client build pages

Each build and repair job has a client-facing page that can be shared with your customer. These pages are password-protected:

  • A unique password is automatically generated when you trigger the first stage update for a job. It is sent to your customer by email along with the page link.
  • These pages are not indexed by search engines and are not publicly discoverable without both the link and the password.
  • You are solely responsible for who you share the link and password with. We are not responsible for unauthorized access resulting from you sharing credentials with unintended parties.

8. Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any losses arising from service interruptions.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

10. Limitation of liability

To the fullest extent permitted by applicable law, Looth and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service. Our total cumulative liability to you for any claims arising from or related to the Service shall not exceed zero dollars ($0 USD). You acknowledge that you are using the Service voluntarily and that this limitation reflects the voluntary nature of your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Looth and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in courts of competent jurisdiction in the State of Texas.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, send a notice to the email address on your account at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
